Subpart B - Air Operator Security Programme Requirements

Amendment to rule 108.53(b)

After rule 108.53(b)(11) insert:

; and

(12) the air operator facilitates the deployment of in-flight security officers as part of an in-flight security officer programme applying to New Zealand domestic flights.

Amendment to rule 108.55(b)

After rule 108.55(b)(18) insert

; and

(19) the air operator facilitates the deployment of in-flight security officers and
foreign in-flight security officers as part of any relevant arrangement or agreement between New Zealand and another State.

Amendment to rule 108.55(h)

Replace rule 108.55(h) with:

(h) The requirements of — 

(1) paragraph (b)(12) do not apply to -

(i) an in-flight security officer and anything they are carrying; or 

(ii) any firearm, weapon, ammunition, or other equipment carried or to be carried by an in-flight security officer or a foreign in-flight
security officer; and

(2) paragraph (b)(16) do not apply to international transfer and transit baggage unless the Minister or the Director requires it to be searched.


 

This note is not part of the Rule but is intended to indicate its general effect.

  • This rule amends the Civil Aviation Rule Part 108, Air Operator Security Programme (the principal rule). 
  • This rule amends the principal rule to require domestic air operators to include procedures for facilitating deployment of in-flight security officers in their security programmes in the event a domestic in-flight security officer programme is initiated.
  • This rule also amends the principal rule to require affected international air operators to include procedures for deployment of New Zealand in-flight security officers or foreign in-flight security officers on international flights.
  • These requirements only apply to air operators that are subject to a domestic programme or are covered by a State-to-State arrangement or agreement between New Zealand and another State, providing for the deployment of in-flight security officers.
  • This rule aligns the obligations on an airline to search passengers and their carry-on baggage with the requirements in Part 140 relating to the searching of in-flight security officers and their weapons by the aviation security service provider.
